German Citizenship for Iraqi Citizens
Why becoming German does not end your Iraqi citizenship, what the Iraqi Embassy in Berlin offers, and how German authorities handle Iraqi documents that can no longer be legalised.
Can Iraqis keep their citizenship when they become German?
Yes. Germany has not required you to give up your previous citizenship since 27 June 2024, and Iraq's Nationality Law No. 26 of 2006 says an Iraqi who obtains a foreign nationality keeps Iraqi nationality unless they declare in writing that they renounce it (Article 10, in the Iraqi Ministry of Justice's English translation). Iraqi courts apply Iraqi law to dual nationals, and dual nationals cannot hold a high security or sovereign post in Iraq unless they give up the other nationality. On the German side, Iraqi documents can no longer be legalised, so your Einbürgerungsbehörde decides whether it accepts them, and your identity must be clarified before naturalisation. In 2025, 13,792 Iraqi citizens were naturalised in Germany.

Iraqi Documents: No Legalisation, and What Happens Instead
| Point | What applies |
|---|---|
| Federal Foreign Office list (02.05.2025) | Iraq is on the list of states where the conditions for legalisation are not met, marked with two asterisks: German missions currently cannot check documents from Iraq. |
| German Embassy Baghdad and Consulate General Erbil | They found that the conditions for legalising Iraqi documents are not met, and stopped legalisation with the approval of the Federal Foreign Office. Checking Iraqi documents for formal authenticity and correct content is not possible because of the security situation. |
| What the German authority does instead | It is at the discretion of the authority you submit an Iraqi document to whether it treats it as genuine without further proof (§438 Abs. 1 ZPO). |
| Forensic check | Under certain conditions the authority can have the document examined by the responsible state police office. |

How You Prove Your Identity Without a Passport
§10 Abs. 1 StAG requires that your identity and nationality are clarified. In its judgment of 23 September 2020 (1 C 36.19) the Federal Administrative Court set out steps. You may move to a later step only if, despite cooperating fully, you cannot prove your identity at the earlier one.
| Step | What counts as proof |
|---|---|
| Step 1 | A passport, or else a recognised passport substitute or another official identity document with a photo, such as an identity card. |
| Step 2 | If getting such a document is objectively impossible or cannot reasonably be expected of you: other suitable official documents, such as a driving licence, service card or military pass, or birth certificates, registration, baptism or school certificates. |
| Step 3 | Non-official documents that support your details, and witness statements where appropriate. The authority may not ask for or accept a statutory declaration (Versicherung an Eides statt). |
| Step 4 | If no other evidence is possible or reasonable: exceptionally, your own statements, if the authority is convinced by them after weighing all circumstances of your case. |

From Iraqi Papers to a German Passport
Check your Iraqi identity documents
A valid passport is the first proof of identity. The Embassy in Berlin issues electronic passports to adults only on the basis of the national card, which you can apply for through the Consulate General in Frankfurt.
Tip: If you have refugee status or subsidiary protection, ask your Einbürgerungsbehörde before you contact Iraqi authorities or the embassy.
Fill gaps through relatives in Iraq
If you have no originals, the Embassy suggests asking relatives in Iraq for copies or the family register extract and getting documents through a power of attorney.
Tip: If you have refugee status or subsidiary protection, ask your Einbürgerungsbehörde before relatives or a lawyer contact Iraqi authorities for you.
Ask your Einbürgerungsbehörde which Iraqi documents it accepts
Iraqi documents cannot be legalised. Whether the authority accepts them as genuine is its decision; it may have them examined by the state police.
Apply with B1 and the citizenship test
Submit your application with your identity documents, your B1 certificate and the citizenship test certificate. You do not have to give up Iraqi citizenship.
Decide whether you want to stay Iraqi
You stay Iraqi unless you renounce in writing. If you want to renounce and live in Hamburg, Saxony-Anhalt, Saxony, Schleswig-Holstein, Bremen, Lower Saxony, Berlin, Brandenburg or Mecklenburg-Western Pomerania, the Embassy in Berlin takes the application with your original Iraqi documents and your German ID or naturalisation certificate. In other states, ask the Consulate General in Frankfurt which mission is responsible.
Tip: Under the 2014 instructions, minor children of the person who renounces lose Iraqi nationality "owing to their father".

Frequently Asked Questions
Yes. Article 10 of the Iraqi Nationality Law No. 26 of 2006 says an Iraqi who obtains a foreign nationality keeps Iraqi nationality unless they declare in writing that they renounce it. Germany has not required you to give up your previous citizenship since 27 June 2024.
We found no such duty in the Nationality Law or the 2014 implementing instructions. Note that Iraqi courts apply Iraqi law to dual nationals, and dual nationals cannot hold a high security or sovereign post in Iraq unless they give up the other nationality.
The Iraqi Embassy in Berlin offers renunciation for people living in Hamburg, Saxony-Anhalt, Saxony, Schleswig-Holstein, Bremen, Lower Saxony, Berlin, Brandenburg and Mecklenburg-Western Pomerania. You need the application, all original Iraqi documents and your original German ID or naturalisation certificate. It takes effect from the date of the director-general's decision. The 2014 instructions add that minor children of the person who renounces lose Iraqi nationality "owing to their father".
Yes. The Embassy in Berlin issues electronic passports; for adults only on the basis of the national card, with the old passport and in person. The first issue costs $73.06. The national card itself is not available in Berlin; you can apply through the Consulate General in Frankfurt.
It decides itself. German missions stopped legalising Iraqi documents because their authenticity and content cannot be checked. Whether a document is accepted as genuine is at the discretion of the authority, which can also have it examined by the state police.
It depends on your protection status and your case. If you have refugee status or subsidiary protection, ask your Einbürgerungsbehörde, and if you wish a counselling service or a lawyer, before you contact the Iraqi embassy or Iraqi authorities. The authority decides what can reasonably be expected of you in your case. The Federal Administrative Court expects a passport first; other evidence is possible if getting one is objectively impossible or cannot reasonably be expected of you, and the court names refugees' fear that contacting their home country could lead to reprisals against others as one such reason. The federal application guidance says that, in discretionary naturalisation, the procedure should be made easier and faster for holders of a refugee travel document (recognised asylum seekers and Geneva Convention refugees, not people with subsidiary protection), and that difficulties in obtaining documents should be taken into account. Berlin's 2022 guidance, which binds only Berlin's offices, says getting a passport is in principle reasonable even for recognised refugees and people with subsidiary protection. It says you must credibly explain in your own case why it is not, and that refugee status, but usually not subsidiary protection alone, must be taken into account. Berlin's country-by-country annexes were not available to us.
13,792 Iraqi citizens were naturalised in 2025, after 13,545 in 2024 (Destatis). They had lived in Germany for 9.0 years on average, compared with 12.4 years for all new citizens.
